Terms and Conditions
Welcome to Balut NZ! These Terms and Conditions govern all purchases of our products. By placing an order with us, you acknowledge that you have read, understood, and agree to be bound by these terms.
1. Our Commitment
We are committed to providing high-quality, authentic balut prepared in a facility that follows strict food safety guidelines.
2. Product Information & Food Safety
We make every effort to ensure our product descriptions and information are accurate.
Storage & Handling: Upon receipt, our products must be refrigerated immediately and stored correctly. Please adhere to the "use-by" date provided.
Allergens: Our primary product is duck eggs. While we follow strict food hygiene practices, we cannot guarantee the absence of all potential cross-contaminants.
Safe Consumption: It is the customer's responsibility to handle, store, and cook the product safely and adequately before consumption.
3. Ordering and Payment
Payment is due in full at the time you place your order.
We accept major credit cards, PayPal, and direct bank transfer.
An order is confirmed only when payment has been successfully processed and you have received an order confirmation email from us.
4. Shipping and Delivery
We ship our products throughout New Zealand using NZ Post. Shipping costs are calculated at checkout.
We take great care in packaging our perishable products to ensure they arrive in excellent condition.
It is our responsibility to get your order to you safely. If your order arrives damaged or spoiled, you must contact us within 24 hours of delivery. Please provide your order number and photographic evidence of the issue.
We will work with you to provide a suitable remedy in accordance with our legal obligations. While we aim to meet estimated delivery times, we are not liable for delays outside of our direct control (e.g., nationwide courier network disruptions).
5. Your Rights: Cancellations, Refunds & Returns
We meet all our obligations under the New Zealand Consumer Guarantees Act 1993 (CGA).
Faulty or Damaged Goods: If the products you receive are damaged, spoiled, not of acceptable quality, or do not match the description provided, you are entitled to a remedy. Please contact us immediately.
Change of Mind: Due to the perishable nature of our products, we do not offer refunds or accept returns if you simply change your mind. Please choose carefully.
Order Cancellations: If you wish to cancel an order, please contact us immediately.
6. Limitation of Liability
To the maximum extent permitted by law, Balut NZ shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use or misuse of our products. Nothing in these terms is intended to limit your rights as a consumer under the Consumer Guarantees Act 1993.
7. Privacy
We are committed to protecting your privacy. Personal information you provide is collected solely for the purpose of fulfilling your order. We will keep your information confidential and will not share it with third parties, except as required to process your payment and ship your order (e.g., with our payment gateway and courier).
8. Dispute Resolution
We hope you have a wonderful experience with us. However, if a problem arises, we ask you to please contact us directly first. We will do our absolute best to resolve the issue with you. If we are unable to reach a satisfactory resolution, you have the option of taking the matter to the New Zealand Disputes Tribunal.
9. Governing Law
These terms and conditions are governed by and will be interpreted in accordance with the laws of New Zealand.
10. Changes to Terms
We reserve the right to update these Terms and Conditions at any time. The terms that apply to your order will be those published on our website at the time you placed your order.
